Statement of Warranty
This policy was last updated on February 25th, 2009.
Special note regarding product pricing on February 25th, 2009 for US and International customers. For a period of several hours, US dollar pricing on our website was incorrect due to a problem with the exchange rate provided to us by our currency exchange data provider. Any person with orders affected by this technical problem have been contacted via telephone and/or e-mail. We have taken steps to prevent this issue from reoccurring in the future and we thank you for your understanding. All prices for US dollar items have now been corrected. Please note: Canadian dollar orders were not affected by this temporary issue.
Shark Systems warranties all goods sold for the period specified under "Warranty" on an items
respective product page. This warranty covers defects in materials and workmanship. Acts of god, product abuse such
as overclocking, improper power protection, or unauthorized third party servicing are not covered by our warranty.
Shark Systems will not cover any damages or data loss of any description due to usage of third party software or
usage of hardware not otherwise purchased from or authorized by Shark Systems. Data security is the responsibility
of the end user and proper backup procedures are mandatory. It is important to note that the manufacturers warranty
period often extends beyond the warranty offered by Shark Systems. Warranty service may be obtained by the customer
via the product manufacturer (OEM) or through Shark Systems during the specified warranty period(s). If Shark
Systems replaces or repairs an item, the warranty period is not extended beyond that of the original warranted
item.
Special Note for US or International Customers: If for any reason the manufacturer of your
item will not honor the warranty on your item(s) in your country, Shark Systems will warranty the item on your
behalf. The item must still fall within the warranty eligible period, and you (the customer or end user) must pay
return shipping to Shark Systems. We will then return the item to the manufacturer for repair or replacement on
your behalf. In regards to damaged items, please consult the section below tilted "Damaged Shipments".
Damaged parcels are NOT covered by our warranty nor the warranty of the manufacturer and instead must be put thorugh the shipping carriers damage claims process.
Please see the section below, "Damaged Shipments" which explictly describes the procedures and liabilites involved with receipt of a damaged parcel.
All new orders are considered to be a "request for stock" - Shark Systems is not responsible for pricing errors on our website and will notify you if we are unable to fulfill your order. Under most circumstances, you are recommended to use the same shipping and billing address for your order. We do not ship to PO boxes. Shark Systems reserves the right to deny submitted orders for any reason.
30 Day Guarantee
If you are not satisfied with a product purchased from Shark Systems during the first 30 days of
ownership you may return it to us for a refund, less a 15% restocking fee.* The customer is responsible for the
cost of shipping the product back to Shark Systems. Please note, if the item is defective or "Dead On Arrival"
(DOA) the item will be repaired or replaced and is not eligible for a refund. (see "Dead On Arrival (DOA) Products"
Damaged Shipments fall under the category below "Damaged Shipments" and do not qualify for the 30 day Guarantee as the item is non-returnable and must be processed as a damage claim through the shipping courier, please see below for more details.

Damaged Shipments or Missing Items
All orders are fully insured unless we are explicitly instructed by the customer to reduce or remove insurance prior to shipment.
Any damaged parcels you receive from Shark Systems should be reported to the courier and Shark Systems immediately and no later than 2 (two)
business days from the date of receipt. If damage is clearly evident you should refuse the shipment at time of delivery and Shark Systems will
open a claim upon return of the damaged goods. Payment of any damage claim is dependent solely upon the outcome of the courier(s) damage claims process. Shark Systems will not be held liable for damaged parcels.
If delivery is accepted you assume 100% responsibility and liability for the shipment and the item(s) contained therein. Any damage claim initiated after you sign for a shipment (take delivery) is between you (the consignee) and the shipping carrier (such as UPS or FedEx). You assume full liability for any damages upon signing for and/or taking delivery of an order. Shipping insurance is a contract
between the customer and the shipping courier. You should immediately report any damage present to the item(s) as well as any missing items to the shipping carrier (please also inform Shark Systems so we may assist you in opening the damage claim or missing items process and obtaining insurance payment)
You must retain the damaged item(s), the box or boxes the goods were shipped in, as well as all packing materials including but not limited to packing peanuts, paper shreds, kraft paper, bubble wrap, Styrofoam etc. All orders are insured for their full value unless Shark Systems is instructed to declare an item at a lower value by the customer at the time of order.
Damaged parcels are a rare circumstance beyond the control of Shark Systems however we will always work with the shipping courier in the best interest of our customers to obtain payment to honour the insurance contract assumed with the purchase of shipping insurance. Shipping insurance is a contract between the customer and the shipping courier. Shark Systems role is to provide our customers securely packaged goods to mitigate the need for a damage claim. All damage claim payments are dependant on the outcome of the couriers damage claim procedure and investigation. Your full cooperation is requested in working with the shipping courier and Shark Systems to facilitate the claim investigation. Shark Systems will not be held liable for unpaid claims however we will ensure the following:
A) All shipments are to be insured for their full value unless the customer instructs Shark Systems to declare an
item at a lower value at the time of order.
B) All shipments are well packed in the original manufacturers factory box or boxes with extra
protective packing materials as well as extra boxing when deemed appropriate.
C) Damage claims will be reported to and followed up with the shipping courier in a timely manner. In the event of
an approved insurance claim investigation, the insured value of the damaged goods including the cost of freight or
shipping will be refunded to the customer in full in a timely manner.
Product Return Procedures (RMA)
When shipping an item for repair or replacement please include ALL materials that came with the product including but not limited to: driver CD's, anti-static bags, instruction manuals, cables etc. The customer must purchase shipping insurance for return shipments as Shark Systems will not be responsible for any losses or damages during shipping. The customer is responsible for the cost of shipping the product back to Shark Systems. Shipping charges are not refunded under any circumstances.
Dead on Arrival (DOA) Products
A request for an RMA (Return Maintenance Authorization) should be placed within 7 days of receiving an item if it is found to be non-working on arrival. The product and all accessories should be returned for repair, replacement, or a refund at Shark Systems option. The customer must pay the cost of return shipping. In some instances where an item is not stocked, the manufacturer will service or replace the product which may add up to 15 business days to the returns process. “Special Order” items may only be exchanged for an identical item. Software may not be returned under any circumstance.

Shipment and Delivery
Shipping times can vary depending on the shipping method chosen and the shipping destination. The
customer is responsible for any duty, taxes, customs brokerage fees or any other fees involved in the importation
of goods from Shark Systems. If you have specific inquiries about importing please direct your inquiries to the
shipping courier. We normally ship out new orders within 1-2 business days (Canada) or 1-3 business days (US or
International). Orders over $1000 CAD are shipped on a customer shipping account (UPS, Fedex, Purolator or DHL).
Please note most shipping carriers do not operate during certain holidays. Certain parcels destined
outside of Canada may incur an overweight shipping charge from the shipping carrier. Provided we are able to show
proof of the cost of shipping for the selected service this additional charge for overweight parcels may be charged
at the time of shipping.
Shipment Tracking
Shipment tracking is available via the "My Account". A shipment tracking number will be added to your order status page upon completion of processing and shipment of your order. Please note that most tracking data is normally delayed approximately 24 hours.
